Public Building Construction Costs - Requirement to Spend 1.5% on Green Energy Technology

Oregon state law requires that public entities spend 1.5% of public building construction costs on green energy technology.  The 1.5% for Green Energy Technology program applies to public entities in Oregon. 1.5 percent of the total contract price of a public improvement contract for new construction or a major renovation of a public building must be spent on green energy technology, regardless of the funding source.


Green energy technology includes:

  • Solar technologies such as photovoltaic and solar thermal systems.
  • Passive solar and day lighting systems that reduce whole building energy use by 20 percent or more.
  • Geothermal systems that use geothermal source temperatures of 140 degrees or more to provide heating or make electricity. Geothermal systems in K-12 schools may use a source temperature of 128 degrees or higher. Ground source heat pumps do not meet the green energy technology requirement.

Public entities include, but are not limited to, state agencies, community colleges, school districts and education service districts, and local governments.


If a public body determines Green Energy Technology to be inappropriate for a project, or want to install the technology off-site, the public body must submit a description to the Technical Review Panel and explain their decision. The Technical Review Panel will provide its recommendation to the public body within 60 days. Funds not spent on the current project must be spent on the next building project that the public body undertakes, unless no state funds are included in the project cost. 


Reporting Requirements


Public entities subject to the 1.5 percent requirement must report about their public building projects through the Oregon Department of Energy's 1.5% for Green Energy Technology Reporting Database. All public bodies in Oregon that construct new facilities or renovate existing facilities must comply with ORS 279C.527-528, if certain cost thresholds are met.


What needs to be reported? ALL projects whether Green Energy Technology was determined to be appropriate OR inappropriate and all projects whether or not state funding was included in the total contract price.  Contracting agencies that have determined GET to be inappropriate must request a review by the technical review panel (TRP). The technical review panel recommendation be must be included when the project is reported in the database. The best time to report a project is after the design of the GET is completed and prior to the start of facility construction.

Please report projects by January 12, 2018 so we can include them in the legislative report, due February 1, 2018.
